Terms for server partners

These terms set out how game servers are promoted on PLAYforMONEY: confirming server ownership, the budget and top-ups, campaigns, settling players' play time and the parties' liability.

§ 1. Parties and definitions

  • Provider (we) – [DO UZUPEŁNIENIA: nazwa firmy / imię i nazwisko], [DO UZUPEŁNIENIA: adres], tax ID (NIP): [DO UZUPEŁNIENIA: NIP], e-mail: kontaktatos@gmail.com.
  • Partner (you) – a person or company that adds a game server to the Service and confirms their right to it, together with members of their team acting in the server panel.
  • Server – the Partner's game server added to the Service. Server panel – the part of the Service for managing the Server.
  • Campaign – the Server's Offer to players (coin rate per hour of play, schedule, limits).
  • Budget – the Partner's funds for promoting a given Server. Commission – the Service's fee added on top of players' coins.
  • Team – people with access to the Server panel: the owner (full rights, wallet and team) and managers (campaigns, profile, statistics).
  • Other terms have the same meaning as in the Service's Terms of service, which also apply to Partners.

§ 2. Who can become a Partner

  1. A Partner may be an adult with full legal capacity, or a company or organisation acting through an authorised person.
  2. The Partner confirms that they have the right to manage and promote the Server – they own it or act with the owner's consent.
  3. By adding a Server or requesting a Budget top-up, the Partner accepts these Terms.
  4. If the Partner is a consumer or a sole trader with consumer rights, these Terms do not limit their statutory rights (§ 12).

§ 3. Adding a Server and confirming ownership

  1. You add a Server in the Panel by giving the game and address. We run a test read straight away.
  2. You confirm ownership with a p4m-… code that you add to the Server name or MOTD for the time of verification. The code is valid for 7 days. We check it during a regular read or when you click “Check now”. Once confirmed, the code can be removed.
  3. Whoever confirms ownership with the code becomes the Server's owner on the Service. If another person does so, the previous owners become managers. The Budget belongs to the Server, not to a person. Report a dispute over the right to a Server with the “Contact” form – we may suspend the Server until it is resolved.
  4. The owner invites Team members with a link and is responsible for their actions in the Panel.

§ 4. Server reads

  1. We do not require plugins. We read the public data that the Server provides to every server list (name, map, player count and list, connection time, score, UUID) and use Steam data.
  2. Each Server is read at random every 8–16 minutes, with a single query; servers sharing an IP address are read one after another. We do not increase the read frequency without the Partner's consent.
  3. If a Server hides its player list, verification is limited – the Panel suggests what to change in the configuration (without installing anything).
  4. At the Partner's request we pause reads of the Server.

§ 5. Server profile and content

  1. The Partner is responsible for the profile content: name, description, logo, banner, links and tags. It must be lawful and truthful and must not infringe the rights of others.
  2. The Partner grants us a free, non-exclusive licence to display this content on the Service for as long as the Server is on the Service. We process image files (resize and convert them).
  3. We may hide or remove content that breaks the law or these Terms – reports, statements of reasons and appeals work as in § 12 and § 13 of the Service's Terms of service.

§ 6. Budget and top-ups

  1. You pay for promotion from the Server's Budget. The Budget is kept in Polish zloty: 1 player coin equals PLN 0.01 of the Budget.
  2. The Service has no payment gateway. To top up the Budget, send a top-up request from the Server's wallet in the Panel (this creates a Ticket). We agree the payment method and date with you individually. In the demo version a test gateway is available that does not take any money.
  3. Once we receive the money, our staff book the payment to the Budget manually. You get a notification, and the Server's wallet shows a top-up confirmation numbered in the format P4M/YYYY/MM/NNNN.
  4. A top-up confirmation is not an invoice. Sales documents: [DO UZUPEŁNIENIA: zasady wystawiania faktur, stawka VAT, czy kwoty są netto czy brutto].
  5. The Budget bears no interest and is used only to promote this Server. The Budget can be moved to another Server only by agreement with us.
  6. The Server owner sees and tops up the Budget.

§ 7. Campaigns

  1. You set up the Campaign yourself: the coin rate per hour for players, dates, days of the week and hours (Polish time, also past midnight), the minimum and maximum number of players on the Server, the “new players only” option, a daily Budget limit, a daily minute limit per player and return bonuses (after 3, 7 and 30 days).
  2. Regardless of the Campaign's limits, a daily limit set by the Service on one player's hours on a single server applies – the lower one counts.
  3. You can pause, resume or end a Campaign at any time. A changed rate applies to Sessions accepted after the change; ongoing Sessions are settled at the rate from when they were accepted.
  4. The Offer closes by itself when the Budget is insufficient or the Campaign reaches its daily limit.

§ 8. Settling play time

  1. You pay only for verified play time of players who accepted your Server's Offer. The cost is the player's coins (credited time multiplied by the rate) plus the Commission. A return bonus costs its value plus the Commission.
  2. The Commission (a percentage of the player's coins) is shown on the “For servers” page and in the Panel. Changes to the Commission – § 14.
  3. Bonuses for levels, the nickname tag, referrals, daily bonuses and promo codes are funded by the Service – they are not charged to the Budget.
  4. We estimate play time conservatively from infrequent reads – the result may be lower than the actual play time. You do not pay for players who were on the Server before accepting the Offer, for AFK stretches (in games that report a score), for time beyond limits or for time that cannot be confirmed. A Session lasts at most 6 hours.
  5. The cost of a Session is charged to the Budget after it ends, and the cost of ongoing Sessions is already taken into account when we check whether the Budget is sufficient. You can see all transactions in the Server's wallet and statistics (players acquired, hours, cost, cost per player, returns after 1, 7 and 30 days) in the Panel.
  6. Report objections to a settlement within 30 days of the charge (the “Contact” form, “Partnership” category). We will check the read records and correct the Budget if needed.

§ 9. No manipulation

In particular, it is forbidden to:

  • add artificial players, bots or fake entries to the player list, or otherwise inflate the Server's activity,
  • collect coins in your own Server's Campaigns as the Partner, a Team member or someone acting on their behalf,
  • encourage players to break the Terms of service (e.g. multiple accounts, AFK, bots),
  • impersonate another server or give misleading information in the profile,
  • provide data intended to mislead verification.

In case of a violation we may suspend the Campaign or the Server, reverse coins credited to players in manipulated Sessions and end the cooperation. The cost of Sessions manipulated by the Partner is not refunded.

§ 10. Player data

  1. In the “Players” tab the Team sees players who accepted the Server's Offers in the last 7 or 30 days: nickname and avatar on the Service, in-game nickname from the last Session, number of Sessions, credited time, cost to the Budget and how Sessions ended. All other statistics are aggregate. We do not share players' SteamIDs, UUIDs, IP addresses or device traces.
  2. The Team may block a player from the Server's Offers, giving a factual reason – that player's ongoing Session on the Server then ends, and the time credited up to that moment is settled. The Team may also report abuse to us; we attach the player's recent Session data to the report.
  3. The Partner processes player data from the Panel as a separate controller, in line with the GDPR, solely for settlements and preventing abuse in their Offers – they do not publish it or pass it on.
  4. Team members see each other's nicknames and avatars.
  5. Data the Server collects about its own players (e.g. game logs) is processed by the Partner on their own responsibility as its controller.

§ 11. Suspension and ending the cooperation

  1. You can end your Campaigns at any time and ask us to pause or remove the Server from the Service.
  2. We may suspend a Server or Campaign in case of a breach of these Terms, an ownership dispute, a security threat or at the request of a competent authority – and we tell you why. When a Server does not respond to reads, its Offers close by themselves.
  3. We may end the cooperation with 30 days' notice, or immediately in case of a serious breach.

§ 12. Refund of unused Budget

  1. Unused Budget is refunded on individually agreed terms: [DO UZUPEŁNIENIA: zasady zwrotu – kiedy, w jakim terminie, w jakiej formie i czy z kosztami]. Send your refund request with the “Contact” form.
  2. If you are a consumer or a sole trader with consumer rights, these Terms do not limit your statutory rights, including the right to withdraw from the contract within 14 days of its conclusion. If you ask us to start the promotion before that period ends, on withdrawal you pay for the part of the service performed until then (the Budget used), and we refund the rest.

§ 13. Liability

  1. We do not guarantee a number of players or any results of the promotion. Verification depends on the data provided by the Server and Steam.
  2. We are not liable for interruptions caused by outages of the Server, Steam or the network, or for maintenance. Sessions that could not be verified are not charged to the Budget.
  3. Towards Partners who are businesses (except sole traders with consumer rights) we are liable only for actual loss and up to the total of Budget top-ups in the last 12 months. This limitation does not apply to damage caused intentionally.
  4. The Partner is responsible for their Server, the content of its profile and the actions of their Team.

§ 14. Complaints and changes to these Terms

  1. Send complaints with the “Contact” form (the “Partnership” category) or by e-mail to kontaktatos@gmail.com. We reply within 14 days.
  2. We may change these Terms, including the Commission rate, for important reasons, announcing it on the Service at least 14 days in advance. A new Commission applies to Sessions settled from the date the change takes effect. If you do not agree, you can end your Campaigns and request a Budget refund (§ 12).

§ 15. Final provisions

  1. Matters not covered here are governed by the Service's Terms of service and Polish law.
  2. Disputes with Partners who are businesses are settled by the court competent for the Provider's registered office ([DO UZUPEŁNIENIA: miasto]). Disputes with consumers – by the courts having jurisdiction under general rules.
  3. These Terms exist in Polish and English. In case of discrepancies, the Polish version prevails.
